Robogator policies and compliance framework

These Terms of Use ("Terms") govern your access to and use of the Robogator platform, including all associated websites, services, and tools (collectively, the "Platform"), operated by Demian Huber ("Operator," "we," "us"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

1. About the Platform

Robogator is a general-purpose automation platform that enables users to create and execute workflows, scripts, and processes. The Platform is accessible via the following domains:

2. Use of the Platform

Robogator does not require user registration. No user account is created, and no account credentials are issued, in order to download, install, or use the Software. Paid plans are enabled by means of a license key as described in section 10.

By using the Platform you confirm that you have the legal capacity to enter into these Terms and that, where you use the Platform on behalf of an organization, you are authorized to bind that organization to these Terms.

3. Acceptable Use

You may use Robogator only for lawful purposes and in accordance with these Terms. You agree not to use the Platform to:

  • Violate any applicable local, national, or international law or regulation.
  • Automate the sending of unsolicited messages, spam, or bulk communications without the recipient's consent.
  • Scrape, harvest, or collect data from third-party services in violation of their terms of service.
  • Conduct unauthorized access to systems, networks, or accounts.
  • Distribute malware, viruses, or any other harmful or malicious code.
  • Harass, intimidate, or harm any individual or group.
  • Circumvent security measures or access controls of any service.
  • Infringe the intellectual property rights of any third party.
  • Engage in fraudulent activity or misrepresent your identity or affiliations.

We reserve the right to suspend or terminate access for any user who violates this Acceptable Use Policy, without prior notice.

4. User Responsibility

Robogator is a general-purpose automation tool and the outcome of any automation, workflow, or script depends entirely on your configuration and intent. You are solely responsible for:

  • All automations, workflows, and scripts you create and execute.
  • Ensuring your use of the Platform complies with all applicable laws, including data protection, employment, and consumer protection law.
  • Keeping any license key issued to you confidential and secure.
  • Backing up your data before using the Platform.
  • Obtaining all necessary rights, licenses, and permissions before automating interactions with third-party services or data sources.
  • Verifying the correctness and safety of any automation before deploying it in a production environment.
  • Any harm caused to third parties as a result of automations you build or run.

5. Limitation of Liability

To the maximum extent permitted by applicable law, the operator shall not be liable for any damages of any kind arising out of or in connection with the use of the Robogator platform. This limitation applies regardless of the legal theory under which such damages are claimed, whether in contract, tort, negligence, strict liability, or otherwise, and even if the operator has been advised of the possibility of such damages. Specifically, the operator shall not be liable for:

  • Direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the platform.
  • Data loss, system failures, or security incidents caused by automations, scripts, or configurations created by the user.
  • Damages resulting from faulty, incomplete, or misused automations.
  • Damages arising from the integration of third-party services, APIs, or external systems.
  • Damages resulting from service outages, interruptions, or delays.
  • Loss of revenue, profits, business opportunities, or goodwill, whether foreseeable or not.
  • Unauthorized access to or alteration of user data, accounts, or configurations.
  • Any action taken by automated processes or scripts running on or triggered by the platform.

Where liability cannot be fully excluded by applicable law, the total aggregate liability of the operator shall be limited to the greatest extent permitted by law.

6. No Warranty

The Robogator platform is provided "as is" and "as available" without any express or implied warranties of any kind. The operator expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. No warranty is given regarding uninterrupted availability, freedom from errors, absence of viruses or malicious code, or that the platform will meet the user's requirements. The operator does not warrant that any defects will be corrected or that the platform will be compatible with all systems, devices, or third-party services.

7. Service Availability

The Operator makes no guarantee of uptime, availability, or performance of the Platform. The Platform may be taken offline for maintenance, updates, or unforeseen circumstances at any time and without notice. You should not rely on the Platform for any time-critical or mission-critical operations without independent safeguards in place.

8. Third-Party Services

Robogator may facilitate integrations with third-party services, APIs, and external platforms. The operator assumes no responsibility for the availability, content, privacy practices, security, or actions of such third parties. The use of any third-party service in connection with Robogator is subject to that service's own terms and conditions and privacy policy. The operator does not endorse, guarantee, or assume liability for any third-party service or content accessed through the platform. Any disputes or issues arising from third-party integrations must be resolved directly with the respective third-party provider.

9. Source Code and Intellectual Property Rights

All source code, design assets, documentation, scripts, plugins, and related components of the Robogator platform are the exclusive intellectual property of Demian Huber.

Robogator, including but not limited to its core engine, scripting system, plugin architecture, GUI designer, and all associated materials, is developed and published solely by Demian Huber. All rights are fully reserved.

You may not copy, reproduce, distribute, modify, reverse engineer, or create derivative works from any part of the Robogator platform without express written permission from the owner.

The Robogator name, logo, and all associated branding elements are protected and may not be used without authorization.

Any contributions, suggestions, or feedback submitted to the Robogator project do not grant contributors any ownership or rights over the software, unless explicitly agreed in writing.

10. Software License and Plans

Robogator is licensed, not sold. Subject to these Terms and the plan you have obtained, the Operator grants you a non-exclusive, non-transferable right to install and use the Software as set out below. All rights not expressly granted remain with the Operator.

Plans and Feature Scope

Robogator is offered in a free Beginner Plan and a paid Master Plan. The feature scope, limits, and currently applicable price of each plan are set out under "License information" inside the Software, which forms part of these Terms. In the event of a conflict, the licensing provisions of this section prevail.

Beginner Plan (free)

The Beginner Plan is offered free of charge, for an unlimited number of users and an unlimited number of installations. It may be used for private and commercial purposes. The Beginner Plan provides a reduced feature set as set out under "License information" inside the Software.

Master Plan (paid)

The Master Plan is available against payment of the fee stated under "License information" inside the Software and unlocks the full feature set set out there. The Master Plan is licensed to a single natural person and is limited to a maximum of 24 installations. The license is personal and may not be shared, transferred, resold, or used by more than one individual. All installations must remain under the control of the licensed individual.

Enterprise and Extended Licensing

Licensing for organizations, multi-user deployments, or installation counts exceeding the limits above, as well as premium support, is available upon request. Please contact hello@robogator.io.

License Keys and Activation

Paid plans are activated by means of a license key. License keys are confidential and must not be shared, published, or made available to third parties. The Software may contact the Operator's license service to validate your key and to verify the number of active installations.

Changes to Plans and Limits

The Operator may modify the feature scope or the limits of a plan with reasonable notice. Such changes will not reduce the feature scope of an already paid subscription period.

End of License

Your license terminates automatically upon material breach of these Terms and, in the case of paid plans, upon expiry or cancellation of the subscription. Upon termination of a paid plan, the Software may revert to the Beginner Plan feature set or cease to function. Upon termination for breach you must cease all use of the Software and uninstall it.

11. Suspension and Termination of Access

The Operator reserves the right to suspend or permanently terminate your license and your access to the Platform and its services at any time, with or without notice, including but not limited to:

  • Violation of these Terms or the Acceptable Use Policy.
  • Conduct that is harmful, fraudulent, or illegal.
  • Non-payment of applicable fees.
  • Sharing, publishing, or otherwise misusing a license key.

You may stop using the Platform at any time by uninstalling the Software. Paid plans can be cancelled as described in section 12. Upon termination, your right to use the Platform ceases immediately.

12. Subscription and Payment Terms

If Robogator offers paid plans or features, the following applies:

  • Fees are as displayed under "License information" inside the Software at the time of purchase.
  • Payments are non-refundable unless otherwise stated or required by applicable law.
  • Subscriptions renew automatically unless cancelled before the renewal date.
  • You are responsible for all applicable taxes.
  • The Operator reserves the right to change pricing with reasonable notice.

13. Privacy

Data We Collect

We collect and process limited personal data in connection with your use of the Platform, including:

  • Contact data: your name and email address if you contact us by email or request a license.
  • License data: the license key, and technical identifiers required to verify the number of active installations.
  • Usage data: IP addresses, browser user agent strings, and server log data for security and abuse prevention.
  • Cookies: we use cookies for display preferences and site functionality (see Cookies below).

Legal Basis for Processing (Swiss DSG / GDPR)

We process your personal data on the following legal bases:

  • Contract performance: to provide the Platform and to manage and validate licenses.
  • Legitimate interest: for security, fraud prevention, and platform improvement.
  • Consent: where you have explicitly opted in.

Cookies

We may set temporary cookies to determine whether your browser accepts cookies and to store display preferences such as theme selection. These cookies contain no personal data.

Embedded Content from Other Websites

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

Who We Share Your Data With

We do not sell your personal data. We may share data with law enforcement when required by law, or in connection with a business transfer with appropriate notice.

How Long We Retain Your Data

License and contact data are retained for as long as necessary to administer the license and to comply with statutory retention obligations. Server log data is retained only for as long as required for security and abuse prevention.

What Rights You Have Over Your Data

Under Swiss data protection law (DSG) and, where applicable, the GDPR, you have the right to access, correct, delete, or export your personal data, and to object to or restrict processing in certain circumstances. To exercise these rights, contact hello@robogator.io. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

14. Indemnification

The user agrees to indemnify, defend, and hold harmless the operator, Demian Huber, from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to the user's use of the platform, violation of this disclaimer, infringement of any third-party rights, or any automation or workflow created and executed by the user using Robogator.

15. Dispute Resolution

In the event of a dispute arising from or related to these Terms or your use of the Platform, the parties agree to first attempt resolution through good-faith direct negotiation. If no resolution is reached within 30 days, the dispute shall be subject to the jurisdiction of the competent courts of Zürich, Switzerland.

16. Changes to These Terms

The operator reserves the right to modify or update these Terms at any time without prior notice. Continued use of the platform after any such changes constitutes acceptance of the updated Terms. Users are encouraged to review this page periodically. The date of the most recent revision will be indicated at the top of this page.

17. Governing Law

These Terms are governed by Swiss law. The place of jurisdiction is Zürich, Switzerland.
