Robogator policies and compliance framework

These Terms of Use ("Terms") govern your access to and use of the Robogator platform, including all associated websites, services, and tools (collectively, the "Platform"), operated by Demian Huber ("Operator," "we," "us"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

1. About the Platform

Robogator is a general-purpose automation platform that enables users to create and execute workflows, scripts, and processes. The Platform is accessible via the following domains:

2. Eligibility and Account Registration

You must be at least 16 years old to use the Platform. By using Robogator, you represent that you meet this requirement.

If you register an account, you agree to:

  • Provide accurate and complete information.
  • Keep your login credentials confidential and secure.
  • Notify us promptly of any unauthorized access to your account.
  • Accept responsibility for all activity that occurs under your account.

3. Acceptable Use

You may use Robogator only for lawful purposes and in accordance with these Terms. You agree not to use the Platform to:

  • Violate any applicable local, national, or international law or regulation.
  • Automate the sending of unsolicited messages, spam, or bulk communications without the recipient's consent.
  • Scrape, harvest, or collect data from third-party services in violation of their terms of service.
  • Conduct unauthorized access to systems, networks, or accounts.
  • Distribute malware, viruses, or any other harmful or malicious code.
  • Harass, intimidate, or harm any individual or group.
  • Circumvent security measures or access controls of any service.
  • Infringe the intellectual property rights of any third party.
  • Engage in fraudulent activity or misrepresent your identity or affiliations.

We reserve the right to suspend or terminate access for any user who violates this Acceptable Use Policy, without prior notice.

4. User Responsibility

Robogator is a general-purpose automation tool and the outcome of any automation, workflow, or script depends entirely on your configuration and intent. You are solely responsible for:

  • All automations, workflows, and scripts you create and execute.
  • Ensuring your use of the Platform complies with all applicable laws, including data protection, employment, and consumer protection law.
  • Protecting your account credentials and security.
  • Backing up your data before using the Platform.
  • Obtaining all necessary rights, licenses, and permissions before automating interactions with third-party services or data sources.
  • Verifying the correctness and safety of any automation before deploying it in a production environment.
  • Any harm caused to third parties as a result of automations you build or run.

5. Limitation of Liability

To the maximum extent permitted by applicable law, the operator shall not be liable for any damages of any kind arising out of or in connection with the use of the Robogator platform. This limitation applies regardless of the legal theory under which such damages are claimed, whether in contract, tort, negligence, strict liability, or otherwise, and even if the operator has been advised of the possibility of such damages. Specifically, the operator shall not be liable for:

  • Direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the platform.
  • Data loss, system failures, or security incidents caused by automations, scripts, or configurations created by the user.
  • Damages resulting from faulty, incomplete, or misused automations.
  • Damages arising from the integration of third-party services, APIs, or external systems.
  • Damages resulting from service outages, interruptions, or delays.
  • Loss of revenue, profits, business opportunities, or goodwill, whether foreseeable or not.
  • Unauthorized access to or alteration of user data, accounts, or configurations.
  • Any action taken by automated processes or scripts running on or triggered by the platform.

Where liability cannot be fully excluded by applicable law, the total aggregate liability of the operator shall be limited to the greatest extent permitted by law.

6. No Warranty

The Robogator platform is provided "as is" and "as available" without any express or implied warranties of any kind. The operator expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. No warranty is given regarding uninterrupted availability, freedom from errors, absence of viruses or malicious code, or that the platform will meet the user's requirements. The operator does not warrant that any defects will be corrected or that the platform will be compatible with all systems, devices, or third-party services.

7. Service Availability

The Operator makes no guarantee of uptime, availability, or performance of the Platform. The Platform may be taken offline for maintenance, updates, or unforeseen circumstances at any time and without notice. You should not rely on the Platform for any time-critical or mission-critical operations without independent safeguards in place.

8. Third-Party Services

Robogator may facilitate integrations with third-party services, APIs, and external platforms. The operator assumes no responsibility for the availability, content, privacy practices, security, or actions of such third parties. The use of any third-party service in connection with Robogator is subject to that service's own terms and conditions and privacy policy. The operator does not endorse, guarantee, or assume liability for any third-party service or content accessed through the platform. Any disputes or issues arising from third-party integrations must be resolved directly with the respective third-party provider.

9. Source Code and Intellectual Property Rights

All source code, design assets, documentation, scripts, plugins, and related components of the Robogator platform are the exclusive intellectual property of Demian Huber.

Robogator, including but not limited to its core engine, scripting system, plugin architecture, GUI designer, and all associated materials, is developed and published solely by Demian Huber. All rights are fully reserved.

You may not copy, reproduce, distribute, modify, reverse engineer, or create derivative works from any part of the Robogator platform without express written permission from the owner.

The Robogator name, logo, and all associated branding elements are protected and may not be used without authorization.

Any contributions, suggestions, or feedback submitted to the Robogator project do not grant contributors any ownership or rights over the software, unless explicitly agreed in writing.

10. Account Suspension and Termination

The Operator reserves the right to suspend or permanently terminate your account and access to the Platform at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms or the Acceptable Use Policy.
  • Conduct that is harmful, fraudulent, or illegal.
  • Non-payment of applicable fees (where relevant).
  • Prolonged inactivity.

You may also terminate your account at any time by contacting us. Upon termination, your right to use the Platform ceases immediately.

11. Subscription and Payment Terms

If Robogator offers paid plans or features, the following applies:

  • Fees are as described on the applicable pricing page at the time of purchase.
  • Payments are non-refundable unless otherwise stated or required by applicable law.
  • Subscriptions renew automatically unless cancelled before the renewal date.
  • You are responsible for all applicable taxes.
  • The Operator reserves the right to change pricing with reasonable notice.

12. Privacy

Data We Collect

We collect and process limited personal data in connection with your use of the Platform, including:

  • Account data: name, email address, and login credentials provided during registration.
  • Usage data: IP addresses, browser user agent strings, and session data for security and spam prevention.
  • Comment data: if you leave comments on our websites, we retain the comment content, your name, email, and IP address.
  • Cookies: we use cookies for login sessions, display preferences, and site functionality (see Cookies below).

Legal Basis for Processing (Swiss DSG / GDPR)

We process your personal data on the following legal bases:

  • Contract performance: to provide the Platform and manage your account.
  • Legitimate interest: for security, fraud prevention, and platform improvement.
  • Consent: where you have explicitly opted in (e.g., comment cookies).

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor's IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select "Remember Me", your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

Embedded Content from Other Websites

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

Who We Share Your Data With

If you request a password reset, your IP address will be included in the reset email. We do not sell your personal data. We may share data with Gravatar (via anonymized email hash), with law enforcement when required by law, or in connection with a business transfer with appropriate notice.

How Long We Retain Your Data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What Rights You Have Over Your Data

Under Swiss data protection law (DSG) and, where applicable, the GDPR, you have the right to access, correct, delete, or export your personal data, and to object to or restrict processing in certain circumstances. If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

13. Indemnification

The user agrees to indemnify, defend, and hold harmless the operator, Demian Huber, from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to the user's use of the platform, violation of this disclaimer, infringement of any third-party rights, or any automation or workflow created and executed by the user using Robogator.

14. Dispute Resolution

In the event of a dispute arising from or related to these Terms or your use of the Platform, the parties agree to first attempt resolution through good-faith direct negotiation. If no resolution is reached within 30 days, the dispute shall be subject to the jurisdiction of the competent courts of Zürich, Switzerland.

15. Changes to These Terms

The operator reserves the right to modify or update these Terms at any time without prior notice. Continued use of the platform after any such changes constitutes acceptance of the updated Terms. Users are encouraged to review this page periodically. The date of the most recent revision will be indicated at the top of this page.

16. Governing Law

These Terms are governed by Swiss law. The place of jurisdiction is Zürich, Switzerland.
